Terms & Conditions of participation at CirqueScape

We are committed to keeping you safe while you train with us. These Terms & Conditions (“T&Cs”) are designed to help with this by providing you with important information about CirqueScape’s rules of safe practice.

By joining in with any of our activities, you are agreeing to abide by these Terms & Conditions and our Covid Policy, and you are also agreeing to the terms of our Waiver. Please read through all of them carefully and make sure you understand them.

Please note that these rules apply whether you’re in the studio with us, at one of our events, or joining in online. It’s your responsibility to make sure you’re staying safe. We’re here to help with that and we reserve the right to terminate a session if we think your behaviour is unsafe, but you are ultimately responsible for your own actions.

This policy may change from time to time so please check it periodically. It was last updated on 3 November 2020.

As with any sport or training, there is an inherent risk of injury involved in the activities we provide, but you can minimise the risks by following the rules set out below.

  1. Listen to the instructors – they are there for your safety. Do not get on any piece of equipment until they have told you that it is safe to do so, and if they tell you to stop using a piece of equipment, stop using it. Do not perform a move until they have told you it is safe to do so, and if they tell you to stop what you are doing then follow their instructions as quickly and safely as you can
  2. Do not progress to a new height or difficulty level until instructed to do so
  3. Stick to what you know – don’t jump on a piece of equipment or try to perform a move that you haven’t been trained in
  4. Use untutored training time to work on moves you already know and are confident you can perform safely – wait until you can receive proper instruction on how to execute new moves. Don’t independently try something that you saw someone else doing – there might be important elements of the move that you’ve not noticed or understood that could make it unsafe for you to try just yet
  5. Training together and working on moves together can be fun, but do not teach new skills to other people. Instructors understand common mistakes and know how to safely spot someone trying a new skill for the first time. They also may adapt the way they teach a new move depending on the skills and strengths of the particular student. Teaching someone else that trick you learnt last week may seem simpler than it actually is. For the same reasons, do not accept instruction on a new skill from anyone other than one of CirqueScape’s qualified instructors. Enjoy your training time and leave the teaching to CirqueScape’s experts!
  1. It’s important to warm up and cool down properly – there are compulsory warm ups and cool downs in each class, but it is ultimately your responsibility to decide whether you feel sufficiently warmed up to be doing what you’re doing. Everyone’s body is different – if you don’t feel ready yet, spend some more time warming up before diving into training or a class. Listen to your body. Do take the time to stretch and cool down properly after you finish a training session. Cool downs and stretching are an important tool in injury prevention
  2. Always train with a buddy – there should always be someone in the room who is capable of coming to your assistance should anything unexpected happen. This includes online classes, wherever possible
  3. Avoid loose clothing – it can get caught, which can cause damage to clothing or injuries to yourself or others
  4. Don’t eat or chew gum in the studio – sticky hands make for sticky equipment which we’d like to avoid, but eating or chewing while training can also be a choking hazard. This is equally relevant for any online classes
  5. Use safety/crash mats when you’re practising moves that could involve you falling. This includes but is not limited to aerial training, handstands, acrobatic work and partnering work. Always do everything you can to protect yourself from injury
  6. Never participate in any training while under the influence of drugs, alcohol or any other substance that may impair your ability to participate safely
  1. Remember that there is solid metal equipment hanging from the ceiling, as well as people – keep your eyes and ears open as you move through the studio – make sure you’re not walking head first into a trapeze bar, a hanging person, a flying hula hoop or anything else
  2. Be aware of what’s going on around you – make sure you’re not going to kick, hit or otherwise cause a danger to anyone around you. Be mindful of how much space you need around you to safely train any given move. This is just as relevant for online classes as for in-person sessions
  1. You must report any incidents or injuries sustained during the session to an instructor. This includes any cuts or torn skin
  1. Remove all jewellery before touching any equipment, even if you don’t mind if the jewellery gets broken. It could get tangled or caught which might cause injury to you or might damage our equipment. We’d like to avoid both of these scenarios. If you can’t remove jewellery then it must be securely covered with tape
  2. Make sure that there are no zips, velcro, or other non-fabric embellishments on your training clothes – similarly to jewellery they can get caught on the equipment, potentially causing damage or injury
  3. Make sure fingernails and toenails are trimmed and smooth before using equipment, otherwise they can catch on the equipment and cause damage
  4. If you think a piece of equipment has been damaged or compromised then you must report it to an instructor
  5. If you bring your own equipment to train on or with then it is your sole responsibility to ensure that that equipment is safe for use. If you allow anyone else to train on or with your own equipment you must make it clear that it is your own equipment and does not belong to CirqueScape, and you assume sole responsibility for its use
  6. If you train on equipment that is not owned by CirqueScape then you do so entirely at your own risk. It is your responsibility to check whether a piece of equipment you’re invited to use outside of a tutored class belongs to CirqueScape or someone else
  7. CirqueScape reserves the right to prohibit use of equipment in the studio that is deemed inappropriate for any reason
  1. All classes, workshops, courses, and private tuition bookings must be paid for in full to reserve your place, and spaces will be filled on a first come first served basis.
  2. Party and other group bookings will be secured on receipt of the agreed reservation fee (which may be the full amount of the booking, or any fraction thereof), and must be paid for in full at least two weeks before the date of the session.
  3. Any bookings not paid for in full at least two weeks before the date of the session may be deemed by CirqueScape to have been cancelled by you, and CirqueScape will be entitled to take alternate bookings in place of the booking that is deemed cancelled.
  4. If you find that you can’t make it to a session you’ve booked then your options are listed below by booking type. Please read the conditions on these options carefully before booking.
  5. Of course, if a class or booking is cancelled by us then a refund or option to transfer will be provided.

A. Drop-in/Pay as you Go classes (including online classes)

  1. You may transfer a drop-in class booking to another date or time, as long as this is done at least 48 hours before the scheduled start time of the class you originally booked. Please contact us to request a transfer. Each booking may only be transferred once.
  2. You may cancel a drop-in class booking up to the scheduled start time of that booking. You must do this by clicking the “view booking” button on your registration confirmation email and hitting the “cancel” button. If you’ve made multiple bookings then make sure you cancel the correct booking, as we may not be able to rectify a mistake if the space has been filled. Please be aware that you will not be refunded the cost of the cancelled class.
  3. If you cancel your booking and the space in your originally booked class is subsequently filled by a paying customer then we may offer to transfer the credit to another booking. If offered, the terms of such transfers are at CirqueScape’s discretion and may be subject to an admin fee payable by you.
  4. These rules do not apply to Block Bookings, which are dealt with below.

B. Workshops

  1. You may transfer a workshop booking to another date or time, as long as this is done at least 48 hours before the scheduled start time of the workshop you originally booked. You must do this by clicking the “view booking” button on your booking confirmation email. Your transfer options will be shown when you click the “transfer” button. Each booking may only be transferred once.
  2. You may cancel a workshop booking up to the scheduled start time of that booking. You must do this by clicking the “view booking” button on your booking confirmation email and hitting the “cancel” button. If you’ve made multiple bookings then make sure you cancel the correct booking, as we may not be able to rectify a mistake if the space has been filled. Please be aware that you will not be refunded the cost of the cancelled workshop.
  3. If you cancel your booking and the space in your originally booked workshop is subsequently filled by a paying customer then we may offer to transfer the credit to another booking. If offered, the terms of such transfers are at CirqueScape’s discretion and may be subject to an admin fee payable by you.

C. Termly courses

  1. Termly course bookings cannot be transferred without our express written approval. If you can find someone who is eligible and willing to take your place on your booked course then we may allow that person to take your place. If offered, the terms of such transfers are at CirqueScape’s discretion and may be subject to an admin fee payable by you.
  2. You may cancel a termly course booking up to the scheduled start time of the first date of that course. You must do this by clicking the “view booking” button on your course registration confirmation email and hitting the “cancel” button. If you’ve not yet registered then you must register and then cancel your registration in order to effectively cancel your booking. If you’ve made multiple bookings with us then make sure you cancel the correct booking, as we may not be able to rectify a mistake if the space has been filled. Please be aware that you will not be refunded the cost of the cancelled course.
  3. If you cancel your booking and the space in your originally booked course is subsequently filled by a paying customer then we may offer to transfer the credit to another booking. If offered, the terms of such transfers are at CirqueScape’s discretion and may be subject to an admin fee payable by you.

D. Courses for adults

  1. Course bookings cannot be transferred outside of the booking window (either five or eight weeks, depending on course length) of the flexible course.
  2. You may cancel a course booking up to the scheduled start time of the first date of that course. You must do this by clicking the “view booking” button on your course registration confirmation email and hitting the “cancel” button. If you’ve made multiple bookings then make sure you cancel the correct booking, as we may not be able to rectify a mistake if the space has been filled. Please be aware that you will not be refunded the cost of the cancelled course.
  3. If you can find someone who is eligible and willing to take your place on your booked course within the course dates then we may allow that person to take your place. Such transfers must be of the whole course and not just a part of it, and if offered then the terms of such transfers are entirely at CirqueScape’s discretion and may be subject to an admin fee payable by you.

E. Private Tuition (including online)

  1. If you cancel or fail to turn up to your booked session you will not be entitled to a refund.
  2. Once a booking is confirmed via email, you cannot change that booking without the express written agreement of CirqueScape. CirqueScape will set aside time and equipment for your booking and may have to turn away other bookings as a result. Consequently, CirqueScape is under no obligation in any circumstances to agree to any requests for changes to the time, date, or other details of your booking. If such a request is accepted, then the terms of such changes are at CirqueScape’s discretion and may be subject to additional fees payable by you.
  3. If you can find someone who is able to take your place in your private tuition session as booked then you may request for that person to take your place. If accepted, the terms of such transfers are entirely at CirqueScape’s discretion.
  4. If you’ve booked a group private tuition session and only one of you end up attending, you are not eligible for a refund of the price difference between a solo and group private tuition session.
  5. If you cancel your booking and the space that you originally booked is subsequently filled by a paying customer then we may offer to transfer the credit to another booking. If offered, the terms of such transfers are at CirqueScape’s discretion and may be subject to an admin fee payable by you.

F. Parties and other group bookings

  1. Once a booking is confirmed via email, you cannot change that booking without the express written agreement of CirqueScape.
  2. If you need to make any changes to your booking then please let us know as soon as you can. CirqueScape will set aside time and equipment for your booking and may have had to turn away other bookings as a result. Consequently, CirqueScape is under no obligation in any circumstances to agree to any requests for changes to the time, date, or other details of your booking. If such a request is accepted, then the terms of such changes are at CirqueScape’s discretion and may be subject to additional fees payable by you.
  3. If you cancel or fail to turn up to your booked session you will not be entitled to a refund.
  4. If you cancel your booking and the space that you originally booked is subsequently filled by a paying customer then we may offer to transfer the credit to another booking. If offered, the terms of such transfers are at CirqueScape’s discretion and may be subject to an admin fee payable by you.

G. Vouchers

  1. Vouchers are valid for six months from date of purchase. The session booked with the voucher must fall within that six month period.
  2. You have 14 days to request a refund on an unused voucher, and your 14 days starts from the date that your voucher is sent to you via email. Vouchers will no longer be eligible for a refund once they have been used. A voucher is deemed used when a session has been requested quoting the voucher code and a booking confirmation email has been sent by CirqueScape referencing the voucher code.
  3. After 14 days, all vouchers are non-refundable.

H. Block Bookings

  1. Block bookings cannot be cancelled or transferred to another person.
  2. Class bookings that form part of a block booking cannot be refunded or transferred to another class.
  3. The purpose of the block booking system is to take the stress out of ad hoc bookings for those that always come to the same session every week. Anyone abusing the block booking system will not be permitted to make another block booking.
  1. Be aware that we may be video recording any part of the studio for safety, training or promotional purposes at any time. We may also record online sessions for safety or training purposes. It is your responsibility to let us know if you do not consent to footage or photographs of you being used for promotional purposes
  2. You are welcome to take pictures or videos in the studio, provided that you are not compromising your own or anyone else’s safety by doing so. If you wish to share any images or footage then make sure you have permission to do so from anyone who appears in the footage, even if they are just in the background
  3. Do not record or photograph someone else as the main subject or purpose of your recording without their specific consent. This includes recording instructors during lessons – we’d rather you were listening to the instructions than focusing on recording equipment
  1. You must respect other people. Be responsible for yourself and aware of the welfare of others
  2. The decisions and instructions of the staff must be respected and followed
  3. Do not pressure anyone to do anything they are not comfortable doing, everyone must progress at a pace they are comfortable with
  4. Be considerate of any other people who may be using or present in the facilities and be respectful of their needs. Remember that there may be children around so keep your language and content of discussions appropriate
  5. Parents are responsible for making sure children understand all of these Terms & Conditions to the fullest extent possible for their age
  6. Parents are responsible for their children at all times when they are in the studio with them
  7. CirqueScape accepts no responsibility for the security of personal belongings such as phones, cameras, personal stereos, items of clothing or any other personal possessions. Instructors and staff cannot accept responsibility for the security of personal belongings
  8. CirqueScape will not tolerate any of the following behaviours:-
        1. Bullying, in any form;
        2. Any form of abusive or threatening behaviour;
        3. The use or possession of drugs or any illegal substances.
  1. Please remember that we’re a small business doing our best to navigate our way through a very difficult time. Our T&Cs help us to make the current situation manageable. Please make sure you understand our T&Cs before making a booking with us, and please don’t ask us to bend our rules for your convenience.
  2. If we do make an exception to any of our T&Cs or related rules or guidelines, then that does not amount to an agreement to disregard any of our terms in any future circumstances. We reserve the right to enforce our terms in full at any time.
  3. We reserve the right to decline booking requests from anyone who has repeatedly requested that we make exceptions to our terms.

Our Covid Policy and Waiver form part of our T&Cs. Make sure you have read and understand them as well as the contents of this page before making a booking with us or coming to our studio.
